Terms of service

Preamble 

Theses Terms of Service represent the TERMS OF SERVICES AND GENERAL SALES CONDITION (GSC) concluded between REDNMORE Sàrl ("REDNMORE") and any non-trading natural person of legal age (the "Customer") who makes a purchase on our Internet Site www.ikyum.com (together called the "Parties"). 

The Parties agree that their relationship is governed exclusively by these Terms and Conditions.

REDNMORE reserves the right to punctually modify the General Conditions which will be applicable as soon as they are put online.

 

Article 1 - Scope and modification of the GSC 

The GSC regulate the contractual relationship - and are an integral part of the contract between REDNMORE and the Customer. They are an integral part of the Terms of Use, which are also applicable. In case of discrepancies, the GSC take precedence over the Terms of Use.

By placing an order via the website, the customer acknowledges that he has read, understood and accepted the GSC without any reservation. In the event of disagreement with the GSC, the Customer shall refrain from placing an order via the Site.

The GSC can be changed by RedNmore at any time and without prior notice by publishing a new version on the Website (which supersedes the existing version). Any order placed after the new version has been published is deemed to be acceptance of the new version.

 

Article 2 - Information on the Site

Although REDNMORE tries to inform its Clients in the most complete and faithful way possible about the products. However, the photos, videos and texts illustrating and describing the products "product description", the dimensions and technical specificities of the products, the size guides, etc.), as well as the state of the stocks mentioned on the Site are not contractual and are provided for information only. They do not constitute an offer by RedNmore (and RedNmore does not guarantee their accuracy) and do not constitute a guarantee or promise of quality.

 

Article 3 - Registration

The Customer is solely responsible for the accuracy and completeness of the data he/she provides when registering or filling in (identification) forms on the Site. If necessary, the Client must communicate to REDNMORE any modification of the data he/she has provided, by immediately updating his/her profile.

The Client must indicate :

- a valid e-mail address to which all communications related to the order will be sent. It is up to the Customer to keep this address up to date and to take note of the e-mails sent by REDNMORE (it is up to the Customer to check his Spam for e-mails from REDNMORE). Any communication made to the Client by e-mail will be considered as received by the Client at the effective date and time of receipt, but no later than 24 hours after it was sent by REDNMORE.

- A personal mobile phone number belonging to the Customer and which he regularly checks. The mobile phone number must be in international format with the country code.

When creating a user account :

- The Customer chooses, upon registration, or is given, in the event of a reset, a password enabling him/her to place orders or use other functions of the Site. This password is strictly confidential. It must not be disclosed to third parties under any circumstances. The Customer is solely responsible for the use, storage and security level of his password, which he may change at any time via the Site. He is responsible for any order placed, even without his knowledge, using his password. If the Customer knows or suspects that a third party has access to his/her password, he/she must inform us immediately.

 

Article 4 - Ordering process

Only Customers who are of age, capable of discernment and not under guardianship may place an order via the Site.

Only the procedure available on our Site is valid for the Customer to place an order.

By placing an order, the Customer binds himself and declares to formulate a firm and definitive offer to REDNMORE to buy the selected goods, this under the conditions indicated on the Site. The validity of the offer can be subject to maximum or minimum quantities. Formally, the Customer submits his offer at the moment his payment is approved. The sale is accepted - and therefore the contract is concluded (under the resolutive conditions of articles 10 to 12) - only from the moment REDNMORE sends the Order Confirmation to the Customer.

REDNMORE reserves the right to refuse an offer at its own discretion, without being obliged to give reasons.

The data registered by REDNMORE and the data registered by the payment system constitute an irrefutable proof of the orders respectively the financial transactions.


Article 5 - Prices

The prices are expressed in Swiss Francs (CHF) or in any other currency available on the website and DO NOT INCLUDE VAT or any other tax applicable by the legislation of the state concerned.

Preparation and delivery costs are invoiced in addition, in accordance with the indications mentioned in the Order Confirmation.

The prices indicated on the Website are only valid for the territories of Switzerland and the Principality of Liechtenstein. 

REDNMORE reserves the right to modify its prices at any time. Only the price indicated in the Order Confirmation is valid.

 

Article 6 - Payment

Only the payment methods indicated on the Site are accepted by REDNMORE. 

Any order offer is subject to the prior payment of the total amount of the order, as well as the preparation and delivery costs.

In case of refusal of the offer, the amount paid by the Customer will be refunded (without interest).

Payments are made through the secure servers of REDNMORE's financial partners. Thus, no information or financial data related to the Client is transmitted through the servers of our platform. 

The Client bears all risks of malfunctioning of the payment system, at REDNMORE's entire discharge.


Article 7 - Delivery

Preparation and delivery costs are those mentioned in the Order Confirmation.

The products are shipped to the delivery address indicated by the Customer during the order. The Customer is solely responsible for the accuracy and timeliness of the address given to REDNMORE.

REDNMORE does not assume any responsibility in the event that a product delivery is not successful due to incorrect, partial or outdated information.

The risk for the shipment of the goods is transferred to the customer as soon as the goods are handed over by REDNMORE to the carrier of its choice.
 

In the event that a parcel is returned to REDNMORE by the carrier after an unsuccessful delivery (e.g. if postal deadlines are exceeded, the recipient's address is wrong, etc.), the Customer is informed by e-mail sent to the address he/she has indicated in his/her profile or when ordering. If the Customer does not give any news within 3 months from the sending of the said e-mail, the order is cancelled. REDNMORE is then released from its obligation to deliver the goods and the amount paid by the Customer is retained by REDNMORE as a contractual penalty, this for the balance of all accounts and claims in relation to the order concerned.


The transport costs and risks involved in returning an unclaimed package (also in the event that the carrier does not leave a delivery notice) and/or in a possible reshipment are borne exclusively by the customer, as well as the risks involved in storing the returned goods. REDNMORE can ask the customer to pay the costs before any return shipment.

REDNMORE does its best to deliver the ordered products (whose sale and payment are finalised on the platform) within 7 to 14 working days. This period is however purely indicative and not contractual.

 

Article 8 - Customer's right of revocation (in general)

The Customer may revoke his order under the following (cumulative) conditions:

- The Customer sends his request to the Customer Service by means of the appropriate form or by email to info@ikyum.com, mentioning his intention to revoke his order. The request must be received by REDNMORE within 10 Calendar Days after the delivery of the goods.

- The goods must not have been used or even unpacked. The goods must be in a perfect new condition, suitable for resale.

- The goods must be returned to REDNMORE according to instructions, at the exclusive expense of the Customer, in their original packaging, accompanied by their complete documentation and all possible accessories. The article on the return procedure applies; and

 

Article 9 - Customer's right of revocation (in case of late delivery)

In case of late delivery, the Customer can revoke the order under the following (cumulative) conditions:

- REDNMORE has not shipped the ordered goods (date of delivery to the carrier being proof) within 30 Working Days from the date of sending the Order Confirmation;

- The Customer has sent a request to Customer Services using the appropriate form, or by email to the following address: info@ikyum.com, stating his intention to cancel his order, no later than 40 Working Days after the date on which the Order Confirmation was sent.

- The Customer's request shall reach Customer Services at least 24 hours before the product ordered is handed over to the carrier for delivery.

 

Article 10 - Ikyum's right of revocation

After the conclusion of the contract, REDNMORE is entitled to cancel an order, not yet delivered, at any time and without having to give reasons to the Customer.

 

Article 11 - Consequences of a cancellation

In case of revocation according to articles 8, 9 or 10, the advance paid by the Client (excluding preparation and delivery costs) is reimbursed in cash or, at REDNMORE's discretion, by means of a voucher. The reimbursement is made for the balance of all accounts and claims.

Only claims for the full refund of the advance payment in cash or voucher are due (excluding preparation and delivery costs and without interest). The customer is not entitled to claim any further damages from REDNMORE. 

In case of revocation due to late delivery (article 9) or the exercise of REDNMORE's right of revocation (article 10), REDNMORE is released from its obligation to deliver the goods.


Article 12 - Warranty for defects

The customer has the obligation to check the delivered goods upon receipt of the order.

Insofar as the carrier asks for a delivery note to be signed, it is up to the Customer to make sure that there are no apparent defects at the time of delivery (product delivered that does not correspond to the product ordered, incomplete product, etc.) before signing.

In the event of apparent defects, the Customer (or any other person receiving the goods on his behalf) must indicate this on the delivery note in the form of a handwritten reservation accompanied by his signature. In the absence of such a reservation, the said defects will be considered as accepted.

With regard to defects that are not apparent at the time of delivery against signature or in the absence of such a method of delivery, the Customer must notify Customer Services of any defect within 3 working days of becoming aware of the defect, failing which the defect will be considered accepted. The procedure in article 13 applies to returns.

In case of purchase of several products (batch of products), the defectiveness of a product and its possible replacement or the impossibility to ship it does not invalidate the entire purchase contract. REDNMORE manages the order of each product independently.

 

Article 13 - Return procedure

In case of a general revocation request (article 8) or of a defect (article 12), the Customer must obtain a return authorization from the Customer Service, prior to any return of goods. No goods will be accepted without the return having been accepted and validated by REDNMORE.

Upon receipt of the return authorization, the Customer has 14 working days to return the goods to the address indicated by REDNMORE. If the instructions given by REDNMORE are not followed, or if the aforementioned period is exceeded, the return will be refused and no refund from REDNMORE will be due. The return has to be done with the original packaging and against signature.

The customer is solely responsible for the risks related to the return of the goods. Except in case of justified return due to a defect (article 12), the return costs are at the customer's expense.

Article 15 - Summaries of the GSC

Any summary or extract of the GSC expressed on the website www.ikyum.com does not constitute the GSC and does not form part of it. Only the GSC are authentic. These summaries are for general information purposes only and are not contractual in nature. The Customer may not rely on them.

The General Terms and Conditions of Sale are protected by copyright. REDNMORE prohibits any reproduction, distribution or other use of its GSC, in a modified or unmodified form, REDNMORE reserves the right to prosecute any unauthorised use of the GSC.
